EPA finalized a PFAS Reporting Rule under the Toxic Substances Control Act (TSCA) Section 8(a)(7) that requires companies to report PFAS manufactured or imported into the U.S. between 2011 and 2022. This reporting requirement also includes PFAS that was imported as a part of a product. James Pollack will provide a deep dive on how the reporting rule operates, key questions that manufacturers and importers will need to understand their reporting obligations, how to select the right reporting forms, and how EPA interprets its “known or reasonably ascertainable” due diligence standard. He will also provide a brief update on new state PFAS laws impacting the industry.

James is an attorney at Seattle-based Marten Law, which focuses on consumer product regulatory compliance, emerging contaminants, and environmental review. He leads the firm’s consumer products regulatory practice and helps consumer product manufacturers in a wide array of industries that are working to understand the complicated and shifting regulatory and litigation environments surrounding emerging contaminants. He has extensive knowledge on PFAS regulatory compliance at the federal and state level. His clients include textile and apparel manufacturers, outdoor recreational product manufacturers, food product manufacturers, and retailers. James also works with industry associations to update membership on regulatory developments.
